Termination

These Terms are effective until terminated by Uniqueway Logistic. Uniqueway Logistic may terminate these Terms without notice and at any time. Claims

We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill, or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the website

Events Beyond Our Reasonable Control

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

Consignment Note

The consignment note is non-negotiable, and the consignor acknowledges that it has been prepared by the consignor/ consignee or by Uniqueway Logistic.
The responsibility Uniqueway Logistic for a consignment accepted under a consignment note ceases when the consignee acknowledges the receipt of the consignment by affixing his signature on the Return to Origin copy and/or the delivery sheet.
All consignments under the consignment note are carried at the owner’s risk

Consignor’s Obligation And Acknowledgment

The tendering of material for transportation is deemed acknowledgment and agreement to the terms and conditions stated herein.
The consignor warrants that he is the owner or the authorised agent of the owner of the goods transported hereunder and that the consignor hereby accepts Uniqueway Logistic’s terms and conditions for itself and/or as an agent for and on behalf of any other person having any interest in the consignment.
consignor warrants that each article in the consignment is properly described on the consignment note and it does not contravene the provisions of the Indian Post Office Act or any other law for the time being in force and has not been declared by Uniqueway Logistic to be unacceptable for transport as specified below and that the consignment is properly marked and addressed and packed to ensure safe handling. The consignor also accepts that the consignor or consignee can be contacted by Uniqueway Logistic for the purpose of feedback, or any query related to the consignments sent by the consignor. The consignor indemnifies Uniqueway Logistic against any claim or liability related to this.

Uniqueway Logistic will not carry materials as under:

  1. Classified as hazardous material, dangerous goods, prohibited or restricted articles by IATA (International Air Transport Association), ICAO (International Civil Aviation Organisation), any applicable government department, or other relevant organization.
  2. Not permitted by the laws/rules/restrictions in force or no customs declaration is made when required by applicable customs regulations and/or any other relevant laws..
Any items notified by Uniqueway Logistic to be restricted and/or banned and/or dangerous and/or prohibited from time to time (such items including but are not limited to animals, bullion, currency, bearer form negotiable instruments, precious metals and stones, firearms or part thereof and ammunition, human remains, pornography and illegal narcotics/drugs). Details are available in all Uniqueway Logistic offices on request and also available on the website.
The consignor or consignee or any other third person from whom the transportation charges are recoverable to Uniqueway Logistic shall be solely liable for all costs and expenses related to the consignment and for costs incurred either in returning the consignment to the consignor the consignment.
The consignor accepts the condition that the consignment is being carried by Uniqueway Logistic from the point of rendering only up to the address shown on the Consignment note and in case this shipment has to be rerouted/redirected/returned for any reason whatsoever, the consignor or consignee or any other third person from whom the transportation charges are recoverable to Uniqueway Logistic shall pay in advance all charges levied by Uniqueway Logistic for such rerouting/redirection/return as specified by Uniqueway Logistic. Uniqueway Logistic will hold such shipments at the Destination mentioned on the Waybill for a maximum period of 10 days from the date of shipment. Thereafter, Uniqueway Logistic reserves the right to destroy the consignment without informing the consignor and the consignor shall indemnify Uniqueway Logistic against any claim or liability.
GST (Goods & Service Tax) E-way bill is an electronic waybill for the movement of goods that the Government has introduced. The consignor should ensure compliance as prescribed under GST based on consignment value with an effective date of rollout by Government. Any non-compliance in the generation of an E-way bill by the consignor may result in a delay in delivery/non-delivery of the consignment booked, for which the consignor will be solely liable and the consignor shall indemnify Uniqueway Logistic against any claim or liability arising out of such non-compliance.
Uniqueway Logistic reserves the right to inspect of consignment, furthermore, it hereby clarified that such inspection is a right not the obligation of Uniqueway Logistic, Uniqueway Logistic reserves the right to refuse consignment which is not in conformity to the terms and conditions without facilitating any premise whatsoever.
The consigner or consignee or any other third person from whom the transportation charges are recoverable to Uniqueway Logistic acknowledges Uniqueway Logistic ‘s right of lien on its shipments for any outstanding freight, any other applicable charges, Central, State, and Local taxes, duties, levies, advances arising out of transportation, whether pertaining to past or present outstanding, in respect of any or all consignment carried under this Contract and may refuse to surrender possession of the consignment until all such charges are paid.
If such aggregate sum due Uniqueway Logistic is not paid within 10 days, Uniqueway Logistic reserves the right to sell or even dispose of the goods without prejudice to Uniqueway Logistic legal remedies or recourse to recover the due amount.
